Basis for calculating duties for America

Calculating the duties to be paid to import goods and products into the United States is crucial when setting the sale price offered to American customers (this is called the "United States landed price")

This is the basis for calculating duties for America:

Based on this information, the customs declaration can be determined to best describe the product, and that is the starting point for the search to identify the reference subclass the product belongs to. Once you know the customs heading to refer to, you can find:

CAUTION: After the first four numbers, the American customs code is different from the European customs code used for the same product.

Importing many kinds of goods into the United States incurs a customs charge

A proper customs classification is crucial in calculating the customs duties.

In fact, most of the merchandise to be imported into America is duty-free. The duties, in any case, vary depending on the merchandise category the products to be imported fall under.

Some specific merchandise classes (typically high-tech products) are difficult to classify, and others such as footwear call for careful attention during customs clearance.

Footwear, yarn, fabrics and clothing in general have high duties; industrial products generally have little or no duties; food products should have average duties (roughly 5% to 10%).

Import procedure for the United States

It is essential to prepare your import file for America by involving the customs broker before shipping from abroad to America

Typically, preparation for a United States import is done by the foreign shipper, who works closely with the corresponding American customs broker to ensure that the American import is complete and properly done and that the merchandise clears customs in the United States with no problems, no merchandise holdups and no product confiscations or other delays.

How to calculate duties for the United States

The first step is the customs classification for the merchandise to be imported into the United States

There are three types of customs duties or fees:

The first step in figuring the duties to be applied to imports into America is classifying the merchandise according to the import codes used by the US Customs. To find out the duties applied for US Customs, one refers to the Harmonized Tariff Schedule, a table that classifies the goods to be imported based on the customs code. This code is 10 digits long, with the first 4 digits indicating the macro-category, and the remaining ones the various types of products within that category.

If the product to be imported cannot be found in the Harmonized Tariff Schedule table, one can contact the US Customs Service and submit customs paperwork including a detailed description of the goods, their intended use, the costs and percentages of the raw material and a sample of the merchandise. If some of the information needed to determine the duties is not available when the merchandise arrives, it is possible to estimate the customs duties due for exporting to the United States and reconcile the under- or over-payments within 15 months.

In addition to the normal duties mentioned above, sometimes anti-dumping duties (named for the practice of selling goods abroad at a lower price than that of their country of origin) or countervailing duties are added. This kind of duties are set in the United States by the International Trade Commission, which ensures fair treatment between importers and companies in the United States of America. Furthermore, sales taxes and a Harbor Maintenance Fee of 0.125% of the bill of lading (to be paid upon entry) are also applied to imports.

Exporting to the United States with an exemption from duties payment

Products imported into America that are addressed to private parties or companies and have a value under $800 are exempt from duties and use a simplified duties procedure. On March 10, 2016, the US Customs updated its "De Minimis Fair Retail Value" from $200 to $800.

The importance of the customs broker to US Customs import practices

An experienced customs broker is the key to a problem-free experience during imports and customs clearance in the United States. The customs broker acts as an agent for the exporter when dealing with US Customs.

An experienced customs broker can recommend the best procedures under any circumstances for fast and problem-free customs clearance in the United States. The customs broker can also take care of the liquidation and payment of the duties with the US Customs.

A note on President Trump's commercial policies regarding US duties

Recently, newspapers in Europe have been dominated by news of a possible increase in duties for goods imported to the United States. According to these press reports, the Trump administration should not discriminate against goods imported from abroad.

The reality is quite different.

The new administration's real goal is rebalancing trade with China and avoiding additional movement of production facilities from the United States and Mexico. The duties imposed on the Vespa Piaggio and French Roquefort cheese, however, are part of a WTO-approved package of punitive duties for not opening the European market to American meat. This is a measure that had already been approved by the Obama administration. Punitive duties set on steel imported from Italy to the USA, however, affects only two Italian manufacturing companies that were found in violation of agreements on state events.

The Biden administration is suspending duties on imports of Italian cheese into America

Following the Airbus case, the WTO awarded countervailing duties to the United States, and this translates to 25% extra duties on the export of Italian cheeses like Grana and Parmigiano Reggiano, for example, and liquor. The change in administration resulted in a truce and the application of countervailing duties was suspended for four months, during which Europe and the USA will negotiate an alternative resolution of the commercial dispute.
