Changes in Customs Procedures for Importing into the U.S. if There Are Components Produced in China

With the enactment of the U.S. law to prevent forced labor in China, importers of finished products or components from China into the U.S. must begin to monitor their supply chains, purchase contracts, and all stages of production.

Starting from June 21, 2022, it is presumed that imports of any goods extracted, produced, or manufactured, in whole or in part, in the Chinese region of Xinjiang or by certain Chinese entities, are made with forced labor, and their importation into the United States is prohibited. This presumption also extends to imported products that contain parts or components sourced from China or have an indirect connection to Xinjiang. The presumption can only be overcome by providing "clear and convincing evidence" to the contrary.

U.S. Customs has emphasized that all importers into the U.S. must thoroughly review their supply chains and implement reliable control measures to ensure that the imported goods are not produced with forced labor in China.
